“How do you think we’re doing?” Robin asked when they were outside the courthouse and away from anyone who might be interested in Stan’s answer.

“I’m feeling pretty good after your cross of the paramedic and Dr. Wolfe. I think you scored some points, especially with the questions about the retinal hemorrhages and the fact that there was swelling when the baby was born. I was watching the jurors when you attacked the shaken baby diagnosis, and I think you’ve got some of them thinking. More important, you’ve laid the groundwork for our experts. What do you think?”

“I didn’t think that Dr. Wolfe was super impressive. Dr. Lancaster’s credentials are way better, and he should make mincemeat out of the abuse allegations. It’s the kidnapping charge that worries me.”

“You’ve put together a good defense, Robin.”

“On paper. I’m not sure it will fly in the real world.”

“That brings up a question of trial strategy. Do we call Marjorie as a witness?”

“I don’t think we can risk it. We aren’t contesting the fact that she kidnapped the baby and assaulted Emily Lindstrom. What we have is a technical defense. We’re arguing that the medical diagnosis Dr. Wolfe made is wrong. Nothing Marjorie could say would help there.”

“She can deny shaking Roy.”

“The jurors might not believe her. She’d have every reason to lie. And Dr. Lancaster will blow the diagnosis of shaken baby out of the water.”

“Which brings us to the kidnapping,” Stan said.

Robin smiled. “We’re going to argue that Marjorie is nuts, and in a way, she already testified in her own behalf when she went crazy in court.”

“So, you think we shouldn’t call her?”

“If we have any chance of getting an acquittal on the kidnapping and assault charges, it will come from Dr. Suarez’s testimony.”
